The 教育 Amendments of 1972 state that no person in the United States shall, 以性别为基础, be excluded from participation in, 被剥夺…的利益, or be subjected to discrimination under any education program or activity receiving federal financial assistance. 第九条 applies to all institutions that receive federal financial assistance, including K-12 schools and institutions of higher education.
美国.S. Department of 教育 Office for Civil Rights enforces 第九条, including investigating and resolving complaints. 另外, the OCR provides institutions with information and guidance in order to provide support in complying with the law.
Examples of 第九条 Violations
- 性骚扰, 性侵犯, 人际暴力, 跟踪 or gender-based harassment having occurred on or off-campus
- Can be based on actual or perceived sex, sexual orientation, or gender identity or expression
- May include acts of aggression, intimidation, or hostility; can be verbal, physical, or graphic
- Not necessarily sexual in nature, 喜欢骂人, 欺凌, or humiliation based on a discriminatory factor
- Favoring men over women (or vice versa) in the classroom
- Being excluded from class or denied coursework because of pregnancy
- Being asked for sexual favors in exchange for things like better grades or a recommendation letter

ACC is committed to providing timely support and assistance to anyone who has been affected by sexual misconduct. “Sexual misconduct” is an umbrella term that refers collectively to the following offenses:

- Sexual assault, which includes non-consensual sexual penetration and sexual touching
- Intimate partner violence, which includes dating and 家庭暴力
- 性剥削

- Gender-based harassment and discrimination that is non-sexual

Employee 报告要求
Information on the 第九条 webpages is provided in response to 34 C.F.R. 部分106.8 of the 2020 第九条 Regulations, mandating notice of a nondiscrimination policy and adoption and publication of grievance procedures that provide for the prompt and equitable resolution of student and employee complaints. In accordance with 第九条, 学院没有, 并且不被要求这样做, discriminate 以性别为基础 in its educational programs or activities. The requirement not to discriminate extends to employment. Inquiries about the application of 第九条 may be referred to the district’s 第九条 Coordinator, to the Assistant Secretary for Civil Rights of the Department of 教育, 或两个.
